SORNA AND THE ADAM WALSH ACT

SORNA refers to the Sex Offender Registration and Notification Act which is Title I of the Adam Walsh Child Protection and Safety Act of 2006

This Act requires that convicted sex offenders provide contact information to their local / State law enforcement officials on a three-month, six-month or yearly basis.

The following information is required on the national sex offender registry:

  • Name;
  • Address;
  • Phone Number;
  • E-mail addresses;
  • Social media profile information;
  • Employment information;
  • Vehicle information and license plate number;
  • Other details may be requested by law.

Depending on what type of crime was committed, you will either be required to register once a year for 15 years or every six months for 25 years or every three months for the rest of your life

Section 2250 of Title 18, United States Code makes it a federal offense for sex offenders required to register with SORNA to knowingly fail to register or update their registration.

PENALTIES FOR NON-COMPLIANCE OF SORNA

When convicted sex offender fails to register as a sex offender, as required by law, they face a heavy fine and a maximum of ten years in prison. This is true if you do not register, or if you do not update the information

For instance, if you move, you need to update the new address – otherwise you face up to ten years in prison.

If a convicted offender commits a violent crime and then also fails to register, he or she faces up to 30 years in prison, plus fines.

You can see it is very important to ensure that your contact information is properly updated. If you fail to give an accurate address, this could be seen as failure to comply.

In addition, if a probation officer has requested registration information, it must be provided in a reasonable amount of time, or this could also be seen as failure to comply.

If you are thought to be in violation of SORNA, you can have a warrant out for your arrest.

In addition, if you fail to comply with certain registration requirements, like attending counseling sessions, you also may face penalties within Pennsylvania. Title 18 § 4915.1 of the PA Code details this requirements.
