Types of Sexual Assault Charges in Pennsylvania:

  • Statutory Sexual Assault: Even with consent, engaging in sexual intercourse or other sex acts with a person below 16 years of age is considered statutory sexual assault. PA Code  § 3122.1
  • Indecent Assault: Charges involve forcing a person to come into contact with bodily fluids in order to make sexual contact with another person without their consent. PA Code  § 3126 
  • Aggravated Indecent Assault: Engaging in unwanted penetration, however slight, of the genitals or anus of a complainant with a part of the person’s body without their consent.  PA Code § 3125
  • Institutional Sexual Assault: Charges apply to people in authoritative positions, especially in correctional facilities, mental health facilities, youth centers, detention facilities, who use their position to force intercourse on persons under their supervision. PA Code § 3124.2 
  • Rape: A first-degree felony, rape is forcing a person to have sexual intercourse without their consent. This can include a person who was given alcohol or drugs and was rendered incapacitated at the time of the alleged crime. PA Code  § 3121 
  • Involuntary Deviate Sexual Intercourse: Similar to rape charges, but including more sex acts, such as penetration with a foreign object. PA Code § 3123 

Rape and involuntary deviate sexual intercourse (IDSI) are types of sexual assault charges, but other types of sex crimes can fall under sexual assault.

Sexual assault charges may not require force or threat in order to be a sex assault crime. For example, statutory sexual assault may apply – because of the age of the victim, a person can be found guilty of sexual assault in a court of law.

Unlawful Contact with a Minor or online solicitation of a minor charges can also lead to arrest and serious penalties, even if no sexual assault crime was committed.

SORNA / National Sex Offender Registry
