What are the maximum penalties for a DUI conviction in Pennsylvania?

If you are convicted of a first time DUI offense at the highest tier of blood alcohol content (BAC) level, you face the following punishment upon conviction:

  • A misdemeanor on your permanent record, a minimum of three days and up to six months in jail, a maximum $5,000 fine; and a one year license suspension. In addition, you will be required to attend alcohol highway safety school and face mandatory drug and alcohol assessment and treatment.

If this is a third DUI offense at the highest tier of BAC level, or a third offense of DUI of a Controlled Substance, you face the following penalties:

  • A felony on your permanent record, a minimum of one year and up to seven years in prison, a maximum $15,000 fine; and an 18 month license suspension. In addition, you will be required to attend alcohol highway safety school and face mandatory drug and alcohol assessment and treatment, as well as one year of mandatory one year Ignition Interlock.
