Indecent Exposure Defined

What is Indecent Exposure?

Indecent exposure is pretty straight forward: if you expose your genitals in any public space or a place where you should have known there are people who would be alarmed or offended by such exposure, this is indecent exposure.

Indecent Exposure can include any of the following examples:

  • “Streaking” or running through any crowd, open area or sports arena naked;
  • Having sexual intercourse in public, in a public restroom;
  • “Flashing” or surprising people by opening a coat or other clothing item to expose your genitals;
  • Public urination.

Are Exposing Breasts Considered Indecent Exposure?

While Pennsylvania generally regards “genitals” to mean the penis or vagina, exposing your breasts in a lewd manner could constitute criminal charges under Open Lewdness laws.

However, breastfeeding is never considered indecent or lewd or offensive, under Pennsylvania Law.

Indecent Exposure as Defined by Pennsylvania Law:

According to PA Code §3127 indecent exposure is defined as:

(a)  Offense defined.–A person commits indecent exposure if that person exposes his or her genitals in any public place or in any place where there are present other persons under circumstances in which he or she knows or should know that this conduct is likely to offend, affront or alarm.

(b)  Grading.–If the person knows or should have known that any of the persons present are less than 16 years of age, indecent exposure under subsection (a) is a misdemeanor of the first degree. Otherwise, indecent exposure under subsection (a) is a misdemeanor of the second degree.

Penalties for an Indecent Exposure Conviction in Pennsylvania

In Pennsylvania, indecent exposure is typically considered a second degree misdemeanor, unless the complainant or victim(s) are aged 16 or younger, in which case it is a first degree misdemeanor.

The penalties will depend on whether the charges are for a first- or second- degree misdemeanor.

A second degree misdemeanor conviction could mean between one to two years in jail and up to $5,000 in fines for a first offense.

A first-degree misdemeanor conviction for indecent exposure can mean up to five years in jail, and a fine of up to $10,000

In addition to jail time and large fines, a sex crime conviction can also mean a lifetime of registering as a sex offender after your release from prison.

The national sex offender registry is known as SORNA (or Megan’s Law). If you are required to register on SORNA, anyone who does a basic background check or conducts a basic Internet search will easily see your criminal history.
