Types of Sex Crime Charges and the Penalties You May Face

Any conviction of a sex crime is going to have roughly the same potential sentence, based on whether it is a misdemeanor or a felony.

Typically, sex crime convictions range from a second-degree misdemeanor to a first-degree felony. The sentencing guidelines in Pennsylvania range from up to two years in prison and a $5,000 fine to up to 20 years in prison and a $25,000 fine. Federal charges or multiple charges may bring additional penalties.

In addition, most convicted sex criminals are required to register on SORNA for the rest of their lives.

Below are descriptions of common sex crimes and the consequences of a conviction.

“Sexting” Conviction Penalties in PA

Every celebrity and Anthony Weiner has participated in this newer form of sexual communication. The problems occur, however, when photos of underage persons are shared, photos are shared without permission, or photos are shared to a person who does not wish to see them (harassment).

Penalties for Teenagers Convicted of Sexting in Pennsylvania:

Sexting is not just common for teenagers, it’s popular. It also borderlines child pornography, a very serious offense. To keep curious teenagers from suffering the same consequences as a child molester, recent sentencing guidelines have been created.

The typical punishment for a teenager in a sexting conviction is a Summary Offense (up to 90 days in jail and a maximum fine of $300).

If the teenager shared a “sext” of another teenager, a conviction means a Misdemeanor (up to one year in jail and a maximum $2,500 fine).

If a teenager is using sexting as a sexual harassment tool, the punishment increases to two years in prison and a $5,000 fine.

The teenager’s phone may also be confiscated, for good.

Penalties for Adults Convicted of Sexting with Minors in Pennsylvania:

If an adult (over age 18) is convicted of a sexting a minor, this could result in a felony and they could receive up to ten years in prison and a $25,000 fine.

Photographing a child or causing a child to participate in pornography is a felony. The convicted adult would also be required to register on SORNA, the national sex offender registry.

Sexual Assault Conviction Penalties

If you are convicted of sexual assault or rape in Pennsylvania, you face a first-degree felony, subject to up to 20 years in prison and a $25,000 fine. Once released from prison, the SORNA law applies.

If the complainant is under age 12, the punishment is more strict and subject to child molestation laws.

Involuntary Sexual Deviate Intercourse (IDSI) Penalties

IDSI is similar to rape but includes a broader spectrum of forced sexual acts. This might be the charge you receive if you are accused of date rape, or if you are accused of having sex with an unconscious person or a person incapable of giving consent, such as a person with a mental disability. Types of sex acts include penetration with a foreign object, oral sex, anal sex, and animal sex acts.

IDSI is a first-degree felony, punishable by up to 20 years in prison and a $25,000 fine. A conviction requires you to register as a sex offender for the rest of your life.

Online Solicitation of a Minor Conviction Penalties

These charges fall under Unlawful Contact with a Minor. With the prevalence of the Internet, these charges are becoming more frequent. Law enforcement if very active in setting up “sting operations” online, the same way they often catch people for prostitution: by posing as a person they are not.

Often they are posing as 13-year-old girls. And if a person solicits the person they think is underage into meeting them (even if they never meet them and never even intend to meet them in person), they can be charged with online solicitation of a minor.

This is also a federal crime, which means if charged, you face penalties at both the state and federal level and will have two sets of courts and prosecutors to defend yourself against.

In Pennsylvania, a conviction means a third-degree felony, punishable by up to seven years in prison and a $15,000 fine.

Other charges may apply and increase the sentencing.

The Sex Offender Registry – SORNA / Megan’s Law / Adam Walsh Act

The stigma of being publicly listed a sex offender is terrifying. Yet, if you have been convicted and are required to be on the national registry, there is no escaping it, unless you want to serve out the entire sentence or go back to prison.

The Sex Offender Registration and Notification Act (SORNA) has very explicit rules that convicted sex offenders must follow in order to stay on the publicly available registry.

For instance, you may be required to list information about yourself and where you live, go to school, and work, making finding a job and housing very difficult, not to mention not being welcomed to the neighborhood.
