It is important to understand how the Commonwealth of Pennsylvania treats charges of theft, robbery and burglary differently and the related consequences of being convicted of these crimes.

  • Theft, such as shoplifting or retail theft, is the intent to deprive a business owner of his or her merchandise. The first and second offenses are misdemeanors, but the third offense is a felony.
  • Robbery is to deprive someone of his or her property through the use of force. This is always treated as a felony.
  • Burglary is the act of breaking into someone’s dwelling to deprive him or her of his or her property. This is also always treated as a felony.

The penalties for a felony conviction are much more harsh than a misdemeanor. But in both cases, heavy fines and jail time could be involved.
