What are the penalties of driving on a DUI-related suspended license in Pennsylvania?

You face jail time for driving on a DUI-related suspended license, whether or not you have alcohol or drugs in your system, but a drugged driving or BAC level while driving on a suspended license – even as low as .02% – has a much harsher penalty.

Under the Pennsylvania Code of Law Title 75 Pa.C.S.A. Vehicles § 1543, you face the penalties below upon conviction of driving on a suspended license.

Please note that these penalties do not include additional time on your license suspension. Anyone caught driving on a suspended, revoked or cancelled license, will have another year (or two) added to their license suspension.

Conviction Penalties for Driving Under License Suspension in Pennsylvania:

  • First Offense: a summary offense, a $500 fine, and a mandatory minimum of 60 days in jail and up to 90 days in jail.
  • Second Offense: a summary offense, a $1,000 fine, and a mandatory minimum of 90 days in jail.
  • Third Offense: a third-degree misdemeanor, a $2,500 fine, and a mandatory minimum of six months in jail.

Conviction Penalties for Refusing a Breathalyzer or Blood Test after a DUI arrest:

  • A summary offense, up to $500 in fines and 60-90 days in jail.

Conviction Penalties for Driving Under License Suspension in Pennsylvania with a BAC Level of .02% or more:

  • First Offense: a summary offense, a $1,000 fine and a minimum of 90 days in jail.
  • Second Offense: a third-degree misdemeanor, a $2,500 fine and a mandatory six months or more in jail.
  • Third Offense: a first-degree misdemeanor, a $5,000 fine and a mandatory 2-5 years in prison.

Restoring a Driver’s License after a DUI Sentence in Pennsylvania

It is common for people to erroneously believe that if their DUI sentence is completed or you have finished the ARD program, it is now OK to drive. But getting your license back does not automatically happen. Furthermore, it is illegal to drive without a physical copy of your driver’s license.

In order to for your license to be reinstated after a completed DUI sentence, you must restore your driver’s license through a process with PennDOT.

If you fail to do so, you will be driving on a suspended license.

There are fees to pay and papers to sign through PennDOT, and if those things are not completely first, you will be driving on a suspended license. You will not receive your license in the mail.
