What is a Protection From Abuse (PFA) Order?

A Protection From Abuse (PFA) order, also known as a restraining order, is a court order designed to protect individuals from abuse, harassment, or threats of harm. In Pennsylvania, PFAs can be issued in cases of domestic violence, including physical, emotional, or sexual abuse, as well as threats of violence, stalking, or intimidation.

When a PFA is issued, the alleged abuser is typically prohibited from contacting or approaching the victim. Additionally, the court may impose additional restrictions, such as barring the abuser from entering the home, prohibiting gun possession, or specifying custody and visitation arrangements for children.

A PFA or restraining order sets rules for a person accused of hurting or threatening you and restricts their access and proximity to you. Your input helps the court determine these rules. If a person breaks the rules according to the PFA, they can be arrested.

To petition for a PFA, you must be, or have been, in a relationship with or a family member of the person against whom you want to file.

The Process of Filing a PFA in Pennsylvania

Our Pennsylvania PFA Attorneys understand that the decision to file a PFA order in PA is deeply personal and often painful. We are here to provide the support, expertise, and guidance you need throughout the process.

There are no court fees in Pennsylvania associated with filing a petition, or the defendant served. If you hire an attorney to help you with the PFA process, you only pay attorney fees, not court fees.

The PFA order filing process generally includes three key stages:

  1. Emergency PFA Order: If you are in immediate danger, you can request an Emergency PFA order, which can be granted outside of normal court hours, often providing immediate protection until the next business day.
  2. Temporary PFA Order: If the Emergency PFA order expires, you will need to file for a Temporary PFA, which offers continued protection while you prepare for a final hearing. A Temporary PFA typically lasts until a full hearing can take place within 10 days.
  3. Final PFA Order: At the final hearing, both parties present evidence before the judge. If the judge finds that the protection is necessary, a Final PFA Order can be issued, which can last up to three years and may be extended if necessary.

  • Up to six months in jail and/or a $1,000 fine;
  • A misdemeanor on your record;
  • Loss of custody rights and other family law consequences;
