Understanding PFAs in Chester County, PA

In Pennsylvania, a PFA is a civil order issued by the court to prevent one person from harming another.

While a PFA does not result in a criminal record, violating the order can lead to serious criminal charges, including arrest and jail time.

A PFA can last up to three years and can include provisions such as:

  • No Contact: The restrained individual cannot contact the plaintiff directly or indirectly.
  • Eviction: The restrained person may be ordered to leave a shared residence, even if they own it.
  • Child Custody: Temporary custody of children can be awarded to the plaintiff.
  • Firearm Restrictions: The restrained individual may be required to surrender firearms.

In Chester County, PFA cases are typically handled in the Court of Common Pleas. The process begins when the plaintiff files a PFA petition, which can lead to an ex parte hearing where a temporary PFA is granted without the presence of the defendant.

Under Pennsylvania law, the burden of proof in a PFA hearing is on the plaintiff, who must demonstrate that they are in danger of abuse, which can include physical harm, threats, stalking, or harassment. However, the standard of proof is “preponderance of the evidence,” which is lower than the “beyond a reasonable doubt” standard used in criminal cases.

A final PFA Order can be ordered for several years, with terms set by the judge. If a Final PFA Order or Permanent PFA Order is issued, it cannot be expunged.

Types of abuse generally include the following:

  • Sexual abuse;
  • Physical abuse;
  • Intimidation of abuse;
  • Physical restraint against a person’s will.

Title 23 of the Pennsylvania Code defines “abuse” as the following:

(1)  Attempting to cause or intentionally, knowingly or recklessly causing bodily injury, serious bodily injury, rape, involuntary deviate sexual intercourse, sexual assault, statutory sexual assault, aggravated indecent assault, indecent assault or incest with or without a deadly weapon.

(2)  Placing another in reasonable fear of imminent serious bodily injury.

(3)  The infliction of false imprisonment pursuant to 18 Pa.C.S. § 2903 (relating to false imprisonment). 

(4)  Physically or sexually abusing minor children, including such terms as defined in Chapter 63 (relating to child protective services).

(5)  Knowingly engaging in a course of conduct or repeatedly committing acts toward another person, including following the person, without proper authority, under circumstances that place the person in reasonable fear of bodily injury. The definition of this paragraph applies only to proceedings commenced under this title and is inapplicable to any criminal prosecutions commenced under Title 18 (relating to crimes and offenses).

What Limits Can a PFA Order Put on You?

Violation of a PFA Order in Pennsylvania

A violation of a PFA Order or Restraining Order could mean up to six months in jail and a $1,000 fine. The rules can be very strict and include not even so much as sending a text message or messaging via social media.
