If you were charged with a sex crime in Pennsylvania – whether it was online solicitation of a minor, sexual assault, marital sexual assault, online pornography or sexting – a conviction can mean years in prison, decades on probation, and a lifetime of having to register as a sex offender (known as SORNA or Megan’s Law).

The sex offender registry is publicly viewable by anyone doing a simple Internet search, putting your reputation on the line.

Employers may not want to hire you, landlords may not want to rent to you, colleges may not want to accept you and any criminal record makes it more difficult to get financial assistance or insurance (automobiles, mortgages, etc.) Not to mention, getting a new girlfriend or significant other may be a challenge.

But a sex crime charge by no means assumes that any of that will happen. Until you are convicted and proven guilty, you have the right to fight your charges.

An Arrest is Not a Conviction

If you were charged with a sex crime, you still have options. Everyone is innocent until proven guilty.

Many people are lured by law enforcement into traps that result in criminal charges. If the police failed to follow strict guidelines while gathering evidence against you, your charges could be thrown out of court completely.

Don’t Give Up Hope: Fight Back

Attorney Wana Saadzoi is an aggressive Pennsylvania Sex Crime Lawyer who has successfully won difficult sex crime cases and eased the burden of criminal sex charges for her clients.

She will fight to have your charges dropped or reduced significantly. She understands that your life and your freedom are important to you and your family and she will do everything possible to defend them.

Types of Sex Crime Charges and the Penalties You May Face

Any conviction of a sex crime is going to have roughly the same potential sentence, based on whether it is a misdemeanor or a felony.

Typically, sex crime convictions range from a second degree misdemeanor to a first degree felony. The sentencing guidelines in Pennsylvania range from up to two years in prison and a $5,000 fine to up to 20 years in prison and a $25,000 fine. Federal charges or multiple charges may bring additional penalties.

In addition, most convicted sex criminals are required to register on SORNA for the rest of their lives.

Below are descriptions of common sex crimes and the consequences of a conviction.

“Sexting” Conviction Penalties

Every celebrity and Anthony Weiner has participated in this newer form of sexual communication. The problems occur, however, when photos of underage persons are shared, photos are shared without permission, or photos are shared to a person who does not wish to see them (harassment).

Penalties for Teenagers Convicted of Sexting in Pennsylvania:

Sexting is not just common for teenagers, it’s popular. It also borderlines child pornography, a very serious offense. To keep curious teenagers from suffering the same consequences as a child molester, recent sentencing guidelines have been created.

The typical punishment for a teenager in a sexting conviction is a Summary Offense (up to 90 days in jail and a maximum fine of $300).

If the teenager shared a “sext” of another teenager, a conviction means a Misdemeanor (up to one year in jail and a maximum $2,500 fine).

If a teenager is using sexting as a sexual harassment tool, the punishment increases to two years in prison and a $5,000 fine.

The teenager’s phone may also be confiscated, for good.

Penalties for Adults Convicted of Sexting in Pennsylvania:

If an adult (over age 18) is convicted of a sexting, this could result in a felony and they could receive up to ten years in prison and a $25,000 fine.

Photographing a child or causing a child to participate in pornography is a felony. The convicted adult would also be required to register on SORNA, the national sex offender registry.

Sexual Assault Conviction Penalties

If you are convicted of rape or sexual assault in Pennsylvania, you face a first degree felony, subject to up to 20 years in prison and a $25,000 fine. Once released from prison, the SORNA law applies.

If the complainant is under age 12, the punishment is more strict and subject to child molestation laws.

Involuntary Sexual Deviate Intercourse (IDSI) Penalties

IDSI is similar to rape but includes a broader spectrum of forced sexual acts. This might be the charge you receive if you are accused of date rape, or if you are accused of having sex with an unconscious person or a person incapable of giving consent, such as a person with a mental disability. Types of sex acts include penetration with a foreign object, oral sex, anal sex and animal sex acts.

IDSI is a first degree felony, punishable by up to 20 years in prison and a $25,000 fine. A conviction requires you to register as a sex offender for the rest of your life.

Online Solicitation of a Minor Conviction Penalties

With the prevalence of the Internet, these charges are becoming more frequent. Law enforcement if very active in setting up “sting operations” online, the same way they often catch people for prostitution: by posing as a person they are not.

Often times they are posing as 13-year-old girls. And if a person solicits the person they think is underage into meeting them (even if they never meet them and never even intend to meet them in person), they can be charged with online solicitation of a minor.

This is also a federal crime, which means if charged, you face penalties at both the state and federal level and will have two sets of courts and prosecutors to defend yourself against.

In Pennsylvania, a conviction means a third degree felony, punishable by up to seven years in prison and a $15,000 fine.

Other charges may apply and increase the sentencing.

The Sex Offender Registry – SORNA / Megan’s Law / Adam Walsh Act

The stigma of being publicly listed a sex offender is terrifying. Yet, if you have been convicted and are required to be on the national registry, there is no escaping it, unless you want to serve out the entire sentence or go back to prison.

The Sex Offender Registration and Notification Act (SORNA) has very explicit rules that convicted sex offenders must follow in order to stay on the publicly available registry.

For instance, you may be required to list information about yourself and where you live, go to school, and work, making finding a job and housing very difficult, not to mention not being welcomed to the neighborhood.

This registry is available for anyone to see. In Pennsylvania, the list is commonly known as “Megan’s Law”. You can try searching by city, state, zip code and even by name here: https://www.pameganslaw.state.pa.us/

The U.S. Department of Justice has a website to search nationally here.

Failing to register as a sex offender properly can mean up to 10 years in prison. But knowingly failing to register can mean up to 30 years in prison.

When your reputation, your freedom and life as you know it are all at risk, you do not want to take chances.

You also do not want to give up hope.

Your defense strategy will depend on the circumstances surrounding your case. It could include denying the allegations and to support these allegations, DNA or forensic evidence could be used in your defense.

A Dedicated Former Prosecutor Representing the Accused

Attorney Saadzoi is a former prosecutor who understands both sides of the courtroom. She understands the tactics a prosecutor may use and how to argue against them and find weaknesses in the prosecution’s case.

There are multiple ways of defending sex crime charges. These can include a case of mistaken identity, false reporting, consent, duress, insanity, intoxication, alibi and impossibility, to name a few.

In any criminal case, prosecutors must prove every element of their case beyond a reasonable doubt. If they cannot do this, they do not have a solid case. Many different angles can show reasonable doubt.

At Saadzoi Law, we will conduct a thorough case investigation in an attempt to show reasonable doubt or missteps in arrest procedures, in order for your charges to be reduced or dropped.
