Penalties of Marijuana Charges in Pennsylvania

Because of local decriminalization ordinances, the penalties for marijuana will depend on where you were charged.

If convicted, you face the following penalties for marijuana charges according to Pennsylvania law:

First Offense Marijuana Conviction:

  • Less than 30 grams of marijuana/cannabis:
    • 30 days in jail, a $500 fine, a misdemeanor on your criminal record, and a license suspension for six months.
  • Over 30 grams of marijuana/cannabis:
    • One year in prison, a $5,000 fine, a misdemeanor on your criminal record, and license suspension for six months.

First Offense Marijuana Paraphernalia Conviction:

Up to One Year in Prison, a $2,500 fine, and a misdemeanor on your criminal record.

Possession with Intent to Distribute Conviction:

  • 30 grams or less for no remuneration:
    • 30 days in jail, a $500 fine, a misdemeanor on your criminal record, and a license suspension for six months.
  • More than 30 grams of marijuana:
    • 5 – 5 years in prison, a $15,000 fine, and a felony on your criminal record.

Penalties increase if the sale was to a minor or within a certain distance from a school, or if it is a second offense.

Penalties for Marijuana Charges in Delaware County, Pennsylvania

Delaware County Council has begun the process of decriminalizing marijuana, but so far only two cities in Delaware County have adopted the measure. (October 6, 2020)

The new ordinance would allow police officers discretion in issuing a $50 civil fine for the purchase, possession, or smoking of less than 30 grams of marijuana. But this is only at their discretion and only if the criminal activity did not take place at any public library or any type of elementary or secondary (middle or high) school.

Currently, Upper Darby Council made possession of 30 grams or less of marijuana and less than eight grams of hashish subject only to a fine and a summary offense.

In Folcroft, PA, the Borough Council also voted to decriminalize marijuana, giving police officers discretion to issue $100 fines instead of an arrest. Read more about the decriminalization of marijuana in Folcroft, PA.
