What is “Simple Possession”?

The difference between simple possession and PWID (Possession with Intent to Distribute) usually involves the amount that you had in your possession at the time of the arrest, however, other factors can contribute to the charges.

The types of drugs in your possession and which Schedule they fall under can also determine whether you are charged with simple possession or PWID.

Penalties for Simple Possession in PA

Jail Time, Fines, and Your License – What Happens after a Drug Conviction?

A first-time drug offense for simple possession is a misdemeanor and can mean up to one year in jail and a $5,000 fine. This is true for less than 5 grams of methamphetamine, less than one gram of heroin, less than 2 grams of PCP or cocaine, and over 30 grams of marijuana. Illegal prescription medication may vary.

If you are charged with PWID or Possession with Intent to Deliver, the penalties will sharply increase.

A second offense could mean up to three years in prison and up to $25,000 in fines.

In addition to the penalties from the courts, PennDOT will suspend your license for a simple drug possession charge. The length of time depends on whether it is a first or subsequent offense.

Penalties for a Small Amount of Marijuana Conviction

If you are charged with a small amount of marijuana in Pennsylvania, you can still face up to 30 days in jail and a fine of up to $500. And it is still a misdemeanor on your record.

Penalties for any amount of Fentanyl Conviction

Because so many people are overdosing and dying, law enforcement is cracking down on any amount of fentanyl possession. If you are convicted, the minimum sentence is two years in prison and a $5,000 fine.

Penalties for Drug Paraphernalia Conviction

If you are charged with drug paraphernalia, you face a misdemeanor on your record, up to one year in jail, and a $2,500 fine.

Penalties for a Heroin Conviction

Since Pennsylvania classifies heroin as a Schedule I substance, a first offense can still mean up to one year in prison and a $5,000 fine, even with less than one gram of heroin.
